Work Hours/Shift: - Full-Time, Monday – Friday
You Will Be Responsible For: - Corporate Operations: Maintaining a working knowledge of the corporate operations of the Managed Population Risk Division. Compliance may be demonstrated by discussions that reflect a review of and familiarity with provisions of incorporating documents and amendments, material contracts and arrangements to which the PHSO is a party and attendance at board meetings as requested. Development of value based physician compensation models in partnership with the financial team.
- Legislation: Responsible for staying abreast of applicable federal, state and local laws and regulations which affect the PHSO or value-based arrangements across AdventHealth division markets, with an awareness relating to its department operations and taking appropriate action (e.g., preventive, corrective, advisory). Compliance may be demonstrated by an ongoing review of legislative enactments, issuance of memoranda to personnel, incorporation of recent legislative enactments in legal research and memoranda, and participation in the development of information for the Department’s intranet site.
- Resource for Other Attorneys: Available for consults with other attorneys within AdventHealth Legal Department as they may reasonably request from time to time. This may include fielding questions from the attorneys, participating in conferences, reviewing draft memoranda, and/or other documents prepared by another attorney.
- Department Functions: Attendance and active participation in staff meetings and such other committees and functions as may be planned from time to time by the Department.
- Department Administration: Participate in the overall development of the Department, internally and externally. This includes (i) identifying and/or participating in initiatives for the Department, communicating the initiatives and monitoring the results of the initiatives; (ii) proposing Departmental policies; (iii) representing the Department in corporate meetings which affect the operations of the Department, etc.
- Contract Writing and Negotiation: This position requires experience and skill in negotiating and drafting contracts, participating provider agreements and other transactional documents, including joint venture arrangements and various governance structures.
Qualifications
What You Will Need: - BA or BS Degree from an accredited university or college
- JD from an accredited law school
- At least five years of legal experience in health law, including significant experience providing advice regarding value-based reimbursement arrangements
- Florida Bar or eligible for Florida Authorized House Counsel
Job Summary: The attorney will be a member of the Legal Services Department of Adventist Health System Sunbelt Healthcare Corporation and its subsidiaries (“AdventHealth”), headquartered in Altamonte Springs, FL. The attorney will advise AdventHealth’s Managed Population Risk Division for all value-based ventures regarding various arrangements in which AdventHealth accepts financial risk for patient care, the Population Health Services Organization (PHSO), Physician Enterprise (PE), New Ventures and AdventHealth division markets (Central Florida, West Florida and Multi-State). Such arrangements include commercial and Medicare bundled payment arrangements, Medicare Advantage physician practices, accountable care organizations, clinically integrated networks, and other arrangements in which the organization is compensated on some basis other than fee-for-service. The position requires thorough knowledge of the Anti-Kickback and Stark laws and analogous state requirements and CMS rules and regulations relevant to the pay-for-value arrangements mentioned above. Further, the position requires experience and skill in negotiating and drafting contracts, participating provider agreements and other transactional documents, including joint venture arrangements and various governance structures. This position reports to the Chief Legal Officer of AdventHealth.
