Position Summary: The USF Self Insurance Program (SIP) Claims and Litigation Manager is an Advanced level position. This individual is primarily responsible for oversight and daily management of medical malpractice claims against the University Board of Trustees for its health care providers, including nursing and medical students, residents, and faculty of the Morsani College of Medicine. This position requires advanced critical thinking, a proficient working knowledge of medical, insurance and legal issues, and the ability to summarize complex medical and legal records both verbally and in writing. The position also requires strong technical skills and the ability to recognize and resolve meritorious claims and formulate appropriate defense strategies as necessary. Experience with Florida Medical Malpractice law and sovereign immunity is preferred. Requires some travel.
Oversight of the daily management and resolution of all medical malpractice cases against the USF Board of Trustees and other protected entities. Gathers and evaluates medical information through interviews of USF healthcare providers and applies that information to relevant legal theories and allegations involved in the case matter. Attends meetings with (potential) co-defendants, co-counsel and other healthcare professionals at serious incident meetings, claims management discussions, etc. Performs extensive review of copious medical records. Performs medical and legal research via Westlaw, periodicals and reviews.
Prepares detailed, written claim summaries. Forms legal strategy and makes indemnity reserve recommendation to the Director of the SIP and to the appropriate Claims Management Committee and/or SIP Council.
Fact gathering through attending depositions and unsworn statements. Decision making with outside counsel, assistant director and/or director on strategy and/or resolution. Resolving claims through attorney negotiations or attending formal mediations.
Educates healthcare providers on professional liability, self-insurance coverage, sovereign immunity and litigation processes.
Signs and approves certificates of coverage and claims history requests. Reviews attorney correspondence and billing invoices.
This position requires a Bachelor's degree and two years of directly appropriate experience.
Three to five years of experience preferably with a strong emphasis on insurance and professional liability defense.
Experience with Florida Medical Malpractice law and sovereign immunity is preferred.
